WHAT FLORIDA REQUIRES

Florida rewrote the rules.
Reserves aren’t optional anymore.

Since 2022, Florida has rewritten the rules for condominium reserves. What your association owes depends on how it is organized and how tall its buildings are.

CONDOMINIUMS & CO-OPS · CHAPTERS 718 & 719

Required, and owners can’t vote it away

  • Buildings three habitable stories or taller need a Structural Integrity Reserve Study (SIRS) at least every 10 years.
  • Reserves for SIRS items must be funded. For budgets adopted on or after December 31, 2024, owners can no longer waive or reduce them.
  • The study, the owner notice and the board’s acknowledgement are now filed with the state on DBPR forms.
  • Other items costing more than the reserve threshold ($25,675 in 2026) need reserves too.
HOMEOWNERS ASSOCIATIONS · CHAPTER 720

Not mandated, still the safest plan

  • HOAs are not subject to the SIRS law.
  • Members can still vote to waive or reduce reserves, which is how most special assessments begin.
  • A reserve study gives the board a defensible budget and owners a clear picture of what’s coming.

WHY FLORIDA IS DIFFERENT

A generic reserve study
doesn’t fit a Florida building.

Hurricanes, salt air and humidity

Storm exposure and coastal moisture shorten the life of roofs, concrete, balconies, windows and waterproofing. Useful lives need to reflect Florida conditions, not national averages.

Lenders and insurers are watching

Fannie Mae, Freddie Mac and carriers look hard at reserves and deferred maintenance. An underfunded building can lose access to conventional financing and coverage, and unit values follow.

Deadlines with board liability

The final SIRS deadline is December 31, 2026. Knowingly skipping a required SIRS is a breach of the board’s fiduciary duty, and directors sign an affidavit when the study is delivered.

HOW SMARTPROPERTY HELPS

Compliance is the floor.
Funding stability is the goal.

SIRS and full reserve studies

A SIRS for your structural items and a full reserve study for everything else, from pools to parking, so the board sees one complete plan.

A plan that stays current

The Living Reserve Study® updates as projects are completed and costs change, so your plan is ready when it’s time for the next update or budget.

Funding options the board can compare

Model higher contributions, special assessments, loans or lines of credit side by side before you take a recommendation to owners.

Numbers you can explain

Atlas shows the cost data and useful-life assumptions behind every figure, so boards can answer owner questions with confidence.
