RESERVE STUDIES IN ARIZONA

Arizona reserve planning

SmartProperty® helps Arizona HOAs and condominiums plan and fund their reserves. Arizona doesn’t require a study, but it does require disclosure. We help your board turn that into a plan that protects owners and resale values.

WHAT ARIZONA REQUIRES

Not required by law.
Disclosed to every buyer.

Arizona leaves the decision to the board, then makes the result public at resale. What your association owes depends on how it is organized.

CONDOMINIUMS · A.R.S. § 33-1201 ET SEQ.

The power to reserve, and the duty to disclose

  • The Arizona Condominium Act gives the board the power to adopt budgets that include reserves.
  • No study or minimum reserve balance is required by state law.
  • The resale disclosure certificate (§ 33-1260) must show the total reserves held and a copy of the most recent reserve study, if any.
PLANNED COMMUNITIES · A.R.S. § 33-1806

Same disclosure, same fiduciary standard

  • HOAs are not required to commission a study either.
  • The same resale certificate shows reserves and any study to buyers.
  • Board members must act in good faith and with the care of an ordinarily prudent person.

WHY IT MATTERS IN ARIZONA

A reserve study is the board’s
best proof of ordinary prudence.

Fiduciary duty without a safe harbor

If a major failure forces a special assessment, the board’s defense is that it acted with ordinary prudence. A professional study is the record of that.

Lenders can see your reserves

Because Arizona resale certificates disclose reserves, lenders see a thin fund right away. An association that looks underfunded can land on a lender’s ineligible list, and buyers are left with cash only.

Desert conditions wear components faster

Heat and sun exposure can shorten the useful life of roofs, paving and mechanical equipment. Useful lives should reflect Arizona conditions, not national averages.

HOW SMARTPROPERTY HELPS

Compliance is the floor.
Funding stability is the goal.

Full reserve studies and updates

A site-inspected study to start, then updates as costs and conditions change, so the board always has a current plan.

A plan that stays current

The Living Reserve Study® updates as projects are completed and costs change, so your plan is ready for the next update or budget.

Funding options the board can compare

Model higher contributions, special assessments, loans or lines of credit side by side before you take a recommendation to owners.

Numbers you can explain

Atlas shows the cost data and useful-life assumptions behind every figure, so boards can answer owner questions with confidence.
