RESERVE STUDIES IN KANSAS

Kansas reserve planning

SmartProperty® helps Kansas HOAs and condominiums plan and fund their reserves. State law doesn’t require a study or a minimum balance, so the board’s fiduciary duty is the standard it will be measured against. A reserve study is how you show you met it.

WHAT KANSAS REQUIRES

Kansas doesn’t require a study.
It does hold the board to a standard.

Neither of the main Kansas statutes sets a reserve requirement. That leaves the board’s duty of care, and its limits on special assessments, to do the work.

KUCIOBORA · KANSAS APARTMENT OWNERSHIP ACT

Silent on reserves

  • The Kansas Uniform Common Interest Owners Bill of Rights Act governs common-interest communities but has no provision for a mandatory reserve study or funding.
  • The Kansas Apartment Ownership Act is also silent, though it lets boards collect for maintenance, repair and replacement of the common areas.
  • KUCIOBORA gives the board the power to adopt a budget.
FIDUCIARY DUTY · SPECIAL ASSESSMENTS

Negligence can cost the board its assessment power

  • Board members must act in the best interest of the association and make informed decisions with the care a prudent person would use.
  • KUCIOBORA allows special assessments, including an emergency one on a two-thirds vote.
  • Special assessments may not be used where the governing body has been negligent. A board that never planned for a predictable roof replacement risks losing that tool.

WHY IT MATTERS IN KANSAS

No mandate doesn’t mean
no exposure.

The special assessment you need may be off the table

If a failure was foreseeable and the board didn’t plan for it, a court could rule the board can’t levy the special assessment to fix it. A professional study is the record that the board acted with ordinary prudence.

Unfunded liabilities are a disclosure problem

Kansas requires a seller’s agent to disclose all adverse material facts, and a large unfunded liability is arguably one. A current study gives sellers, agents and lenders real numbers to work from.

Lenders look at reserves

An association with no study and a weak reserve fund can land on a lender’s ineligible list. Fannie Mae’s 15% reserve minimum applies to condo loans dated on or after January 4, 2027.
