RESERVE STUDIES IN MASSACHUSETTS

Massachusetts reserve planning

SmartProperty® helps Massachusetts condominiums plan and fund an “adequate” replacement reserve, which Chapter 183A requires but never defines. A professional study gives trustees the number and the proof behind it.

WHAT MASSACHUSETTS REQUIRES

The law says “adequate.”
It leaves defining it to your trustees.

Massachusetts mandates the fund but sets no percentage, dollar amount or funding model. The burden of showing adequacy falls on the board.

M.G.L. CHAPTER 183A · SECTION 10(I)

An adequate, segregated reserve fund

  • All condominiums must maintain an adequate replacement reserve fund, collected as part of the common expenses.
  • The fund must be held in an account separate from operating funds.
  • “Adequate” is not defined numerically, so a trustee decision made without professional data is hard to defend.
SECTION 10(M) · TRUSTEES’ DUTIES · SECTION 6

Waivers, fiduciary duty and the lien

  • Reserve requirements can be modified only with the written consent of unit owners holding the interest the master deed requires.
  • Trustees are fiduciaries, and courts typically apply the business judgment rule to informed, good-faith decisions.
  • Unpaid assessments, including special assessments, carry a priority lien for up to six months, ahead of the first mortgage.

WHY IT MATTERS IN MASSACHUSETTS

Older buildings, harsh winters,
and lenders who check.

Freeze-thaw cycles and an aging housing stock

Converted mills, brownstones and mid-century complexes face freeze-thaw cycles, coastal salt and heavy snow loads. Those conditions accelerate wear on roofs, masonry and paving.

Lenders act as the real regulator

Fannie Mae and Freddie Mac effectively require a professional study for a condo to stay financeable. Their reserve minimum rises from 10% to 15% of assessment income for loan applications dated on or after January 4, 2027.

A waiver is a signal to buyers

Owners can vote to modify reserve funding, but doing so announces deferred maintenance to buyers and lenders and can make units ineligible for conventional financing.
