RESERVE STUDIES IN TEXAS

Texas reserve planning

SmartProperty® helps Texas HOAs and condominiums plan and fund their reserves. Texas doesn’t require a study, but resale certificates disclose your reserves and the board owes a duty of care. A study is how you meet both.

WHAT TEXAS REQUIRES

Texas doesn’t mandate the study.
It does mandate the disclosure.

Reserve planning in Texas rests on the board’s powers, its fiduciary duty and what has to be disclosed at resale.

CONDOMINIUMS · PROPERTY CODE CHAPTER 82

Reserves are allowed, and disclosed

  • Section 82.102 gives the board the power to adopt budgets that include reserves.
  • The condo resale certificate (§ 82.157) must state reserves for capital expenditures and any set aside for a specific project.
  • Condo associations with 60 or more units, or a management company, must post their recorded documents online (§ 82.1142).
HOMEOWNERS ASSOCIATIONS · CHAPTERS 207 & 209

Same disclosure, same duty

  • Subdivision resale certificates under Section 207.003 must also state reserves.
  • Reserves are typically authorized by the governing documents rather than statute.
  • SB 2629 made electronic meetings and ballots easier, which helps boards reach a quorum on funding decisions.

WHY IT MATTERS IN TEXAS

No mandate doesn’t mean
no exposure.

The duty of care still applies

Board members must act with the care of an ordinarily prudent person. If a roof or foundation failure forces a special assessment the board never planned for, owners can claim a breach. A professional study shows the board was prudent.

Buyers and lenders read your certificate

Because resale certificates show reserves, a thin fund is visible to every buyer. Low or missing reserves can land an association on a lender’s ineligible list.

The 2027 session is coming

The Texas Legislature meets again in January 2027, and bill prefiling opens in November 2026. Reserve rules elsewhere and Fannie Mae’s 15% minimum keep the topic active.

HOW SMARTPROPERTY HELPS

Compliance is the floor.
Funding stability is the goal.

Full reserve studies and updates

A site-inspected study to start, then updates as costs and conditions change, so the board always has a current plan.

A plan that stays current

The Living Reserve Study® updates as projects are completed and costs change, so your plan is ready for the next update or budget.

Funding options the board can compare

Model higher contributions, special assessments, loans or lines of credit side by side before you take a recommendation to owners.

Numbers you can explain

Atlas shows the cost data and useful-life assumptions behind every figure, so boards can answer owner questions with confidence.
