RESERVE STUDIES IN VIRGINIA

Virginia reserve planning

SmartProperty® helps Virginia HOAs and condominiums stay on the five-year study cycle and meet the budget disclosures that come with it. Since July 1, 2024, boards also have the authority to act on what the study finds.

WHAT VIRGINIA REQUIRES

Virginia requires the study.
Since 2024, it also backs the board.

The Property Owners’ Association Act and the Virginia Condominium Act both treat reserve funding as a requirement, and HB 1209 widened what boards can do about a shortfall.

The five-year cadence

  • A complete study at least once every five years to determine the reserves needed to repair, replace and restore capital components.
  • An annual board review of the results, with budget and assessment adjustments as needed.
  • Since July 1, 2024, the study must determine each component’s physical status and replacement cost, plus an analysis of funding capacity.

Transparency and new board powers

  • The annual budget must show each component’s replacement cost, remaining and total useful life, accumulated cash reserves and the expected contribution.
  • Owners can no longer rescind an additional assessment levied primarily for capital components.
  • Boards may borrow to fund recommended reserves and pledge assessment revenue to repay the loan.

WHY IT MATTERS IN VIRGINIA

Compliance is mandatory.
So is a study that holds up.

Missed cycles can end up in court

The association or aggrieved owners can sue over a missed five-year study or annual review, and the prevailing party recovers attorney fees. A deliberate failure to act on disclosed underfunding can raise a willful misconduct claim.

An on-site look is the safe reading of “physical status”

Virginia doesn’t explicitly require an onsite inspection or a licensed preparer, but a desktop-only update is a risky way to document physical status. An independent specialist with a site visit is the defensible choice.

Lender eligibility rides on reserves

Fannie Mae and Freddie Mac require adequate reserves. Their minimum rises from 10% to 15% of assessment income for loan applications dated on or after January 4, 2027.

HOW SMARTPROPERTY HELPS

Compliance is the floor.
Funding stability is the goal.

Full reserve studies and updates

A site-inspected study to start, then updates as costs and conditions change, so the board always has a current plan.

A plan that stays current

The Living Reserve Study® updates as projects are completed and costs change, so your plan is ready for the next update or budget.

Funding options the board can compare

Model higher contributions, special assessments, loans or lines of credit side by side before you take a recommendation to owners.

Numbers you can explain

Atlas shows the cost data and useful-life assumptions behind every figure, so boards can answer owner questions with confidence.
